Terms of use

1. Seller and acceptance

The GESTE & PERFORMANCE service is published and provided by KEA Thérapie ("we"). By using the service, you contract with KEA Thérapie. By creating an account or continuing to use the service, you accept these terms. Any request about the service can be sent to contact@gesteperformance.com.

2. Description of the service

GESTE & PERFORMANCE is software for documenting and tracking movement assessments, specialised in martial arts and combat sports. It provides no diagnosis, risk score or automatic prescription; decisions remain those of the professional.

3. Accounts and access

You must be of legal age or authorised to bind your organisation, provide accurate information and keep your credentials confidential. You are responsible for activity under your account. Access to the Clinical area is restricted to authorised health professionals designated by their organisation's administrator.

4. Prohibited use

You may not use the service: for unlawful purposes; for fraud or spam; in breach of others' intellectual property or privacy rights; to compromise security (malware, unauthorised penetration testing, automated data extraction); or to disassemble, resell or bypass the technical limits of the service.

5. Intellectual property

KEA Thérapie retains ownership of the service and all its intellectual property (software, protocols, documentation, brand and visual identity). We grant you a limited, non-exclusive, non-transferable right of use within your plan. You remain the owner of the data and videos you upload and grant us a limited licence to host and process them solely to provide the service.

6. Payment and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, invoicing, taxes, renewal, cancellation and refunds are governed by Paddle's buyer terms. Monthly and yearly subscriptions renew automatically until cancelled; see our refund policy. The subscription belongs to the organisation: the Solo plan allows 1 active member, the Club / Clinic plan up to 10. Without an active subscription, the organisation becomes read-only (viewing and export are kept).

7. Service level

The service is provided "as is". We do not guarantee uninterrupted or error-free operation and, to the extent permitted by law, exclude any implied warranty.

8. Liability

To the extent permitted by law, KEA Thérapie's total liability is limited to the amounts paid in the last 12 months and excludes indirect damages (loss of profit, data or reputation). Nothing excludes liability for fraud, death or personal injury where the law forbids it.

9. Suspension and termination

We may suspend or terminate your access in case of serious breach of these terms, non-payment, security or fraud risk, or repeated or serious violations of our rules. When access ends, your data can be exported on request for 30 days, then it is deleted. For an export or an account question, write to contact@gesteperformance.com.

10. Governing law

These terms are governed by French law. Any dispute falls under the competent French courts, subject to protective provisions applicable to consumers.
